Terms of Use

These terms explain how Kalingap works, what our verification checks actually claim, what you can expect from us, and what we ask of everyone using the platform.

1. About these terms

These Terms of Use ("Terms") govern your access to and use of the Kalingap mobile app, website and related services (together, the "Service"). By creating an account or using the Service, you agree to these Terms. If you do not agree, please do not use the Service.

This is version 1.1. When you accept, the app records which version you accepted and when, so it is always clear which text you agreed to.

We may update these Terms from time to time. When we publish a new version, the app asks you to review and accept it the next time you open Kalingap — an old acceptance never carries over silently.

2. What Kalingap is — and is not

Kalingap is a marketplace. We help families and individuals looking for care ("Clients") find independent care providers ("Caregivers"), and we provide the tools to arrange, track and pay for bookings.

Caregivers are independent providers, not employees or agents of Kalingap. We do not direct how care is delivered, set caregivers' schedules, or supervise visits. The care itself is provided under an agreement between the Client and the Caregiver.

Kalingap is not a recruitment, placement or manpower agency, and does not deploy workers overseas. We connect people who are already looking for each other.

Kalingap does not provide medical advice, nursing services or emergency care. In an emergency, contact local emergency services immediately.

3. Eligibility and your account

  • You must be at least 18 years old and legally able to enter into a contract.
  • The information on your account must be accurate and kept up to date — including your legal name, which must match the identification and clearance documents you submit.
  • You are responsible for keeping your login credentials secure and for activity that happens under your account.
  • One person, one account. Do not share an account or let someone else use yours.
  • Caregivers must pass our verification checks before they can accept bookings, and must hold any licences or certifications their services legally require.
  • Clients must have a reviewed government-issued ID before their first booking.

Tell us promptly at support@kalingap.com if you believe your account has been used without your permission.

4. Verification, and exactly what it claims

Kalingap never displays a bare "Verified" label. Every badge names the check that passed and the date it passed, because a generic label would tell you nothing about what was actually done. There are three, and they are separate:

  • Documents submitted — the Caregiver uploaded documents. Nobody at Kalingap has checked them yet. Treat this as an upload, not a result.
  • ID matched — a person at Kalingap compared a liveness selfie against the photo on the submitted ID and confirmed they are the same person.
  • NBI checked — the clearance was verified against the National Bureau of Investigation's own portal, on the date shown.

A check is only accepted when three things agree: the name on the account, the name on the identification document, and the name and number on the clearance — and the clearance must be unexpired. If any of them disagree, no badge is granted and a person at Kalingap reviews the case by hand.

Software may assist the NBI step by reading the Bureau's public verification page on our behalf, to shorten the wait. It can only confirm a result that already satisfies the rule above; anything else goes to a person. It can never reject a Caregiver on its own.

You must not misrepresent, alter or fabricate a document, or submit one that is not yours. Doing so ends your access to Kalingap and may be reported to the authorities.

Verification is not a guarantee. These checks reduce risk and tell you what a record said on the day we looked. They do not warrant any person's conduct, character or suitability. Clients remain responsible for deciding whether a particular Caregiver is right for their situation — reviewing profiles, asking questions, and where appropriate meeting first.

Report any safety concern through the app or at support@kalingap.com. If someone is in immediate danger, contact emergency services first.

5. Bookings

A booking is an agreement between the Client and the Caregiver. Kalingap facilitates it but is not a party to it.

  • The scope of care, schedule, location and rate are shown before you confirm a booking.
  • Changes to a confirmed booking need to be agreed by both the Client and the Caregiver.
  • Cancellation windows and any applicable cancellation fee are shown at the time of booking.
  • Repeated late cancellations or no-shows may lead to restrictions on your account.

6. Payments, fees and payouts

Payments are made in the app through PayMongo, our payment provider, using the methods offered there. Kalingap does not store your full card details.

  • A booking is confirmed once payment is received. The total, including any service fee, is shown before you confirm — you are never charged an amount you have not seen.
  • Kalingap holds the payment until the visit is completed, and accounts for it internally against that booking.
  • Kalingap charges a service fee on each completed booking, deducted from the amount paid. The rate applying to a booking is disclosed at confirmation.
  • Caregiver payouts are released after a completed visit, by bank or e-wallet transfer, on the schedule shown in the app. Where the law requires tax to be withheld, it is withheld and remitted.
  • Refunds and cancellation fees follow the policy shown at the time of booking.
  • Arranging payment outside the app to avoid fees is a breach of these Terms and removes the protections the platform provides.

If you believe you have been charged in error, contact us within 30 days and we will investigate.

7. Community standards

Everyone on Kalingap is entitled to be treated with respect and to be safe. You agree not to:

  • misrepresent your identity, experience, qualifications or verification status;
  • harass, threaten, discriminate against or abuse another user;
  • use the Service for anything unlawful, or ask a Caregiver to do something unlawful or unsafe;
  • solicit users off the platform to avoid fees, or scrape or misuse other users' personal information;
  • interfere with, disrupt or attempt to gain unauthorised access to the Service.

We may suspend or permanently remove accounts that breach these standards.

8. Your information

How we handle personal information is set out in our Privacy Policy, which forms part of these Terms.

Two points matter here. Your identification document, your NBI or police clearance, and health details about a person receiving care are sensitive personal information, and we only collect them once you have given a separate consent to that specific handling — it is not bundled into your acceptance of these Terms. And a Client who shares health details about someone else confirms they are entitled to share them, and shares only what a Caregiver needs to work safely.

You can download a copy of your data, or delete your account, at any time from your profile in the app.

9. Your content

You keep ownership of the content you post — your profile, photos, messages and reviews. You grant Kalingap a non-exclusive licence to host, display and distribute that content as needed to operate the Service.

Only post content you have the right to share, and keep reviews honest and based on your own experience. We may remove content that breaches these Terms.

10. Suspension and closing your account

You can close your account at any time from the app. Doing so deletes your identification and clearance files, your intro video, your profile photo and the other personal details listed in the Privacy Policy.

We may suspend or terminate access if you breach these Terms, if we are required to by law, or if we reasonably believe it is necessary to protect other users. Where it is appropriate and lawful to do so, we will tell you why.

Obligations that by their nature should survive — including outstanding payments, records we are legally required to retain, and the sections on liability — continue after your account closes.

11. Disclaimers and liability

The Service is provided on an "as is" and "as available" basis. We do not warrant that it will be uninterrupted or error-free.

Because Caregivers are independent providers, Kalingap is not liable for the acts or omissions of Clients or Caregivers, or for the quality or outcome of care delivered.

To the maximum extent permitted by law, Kalingap is not liable for indirect, incidental or consequential losses. Nothing in these Terms excludes liability that cannot lawfully be excluded, including liability for death or personal injury caused by negligence, or your rights under consumer protection law.

12. Governing law and disputes

These Terms are governed by the laws of the Republic of the Philippines, and the courts of the Philippines have jurisdiction over any dispute — without affecting any right you have to bring a claim where you live.
